Terms of Service

1. Acceptance of Terms

By creating an account or using Yaadbay ("the Platform", "we", "us"), you agree to these Terms of Service. If you do not agree, do not use the platform. These terms are governed by the laws of Jamaica.

2. Eligibility

You must be at least 18 years old to use Yaadbay. By registering, you confirm that you are 18 or older and that the information you provide is accurate and complete.

3. User Accounts

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You may not share your account or create accounts on behalf of others without permission.
  • We reserve the right to suspend or terminate accounts that violate these terms.

4. Buying and Selling

Sellers

  • Sellers must complete identity verification before listing items for sale.
  • All listings must accurately describe the item. Misrepresentation is grounds for account termination.
  • Sellers must ship or arrange delivery within the timeframe stated in their listing.
  • Sellers must honour confirmed orders. Repeated cancellations may result in account suspension.
  • Seller accounts are subject to a monthly subscription fee as disclosed at the time of registration.

Buyers

  • By placing an order, you commit to completing the purchase.
  • Payment is due at the time of order.
  • Buyers must inspect items and raise disputes within the timeframe specified in our Returns Policy.

5. Platform Fees

Yaadbay charges a platform fee of 10% on each completed transaction. This fee is deducted from the seller's proceeds. Buyers are not charged a platform fee unless explicitly stated at checkout. Payment processing fees are charged separately by the payment provider.

6. Prohibited Items and Conduct

The following are strictly prohibited on Yaadbay:

  • Illegal goods or services of any kind
  • Counterfeit, stolen, or infringing items
  • Firearms, ammunition, explosives, or dangerous weapons
  • Controlled substances or drug paraphernalia
  • Adult content or services
  • Live animals (except legally permitted livestock in the Farmers Market)
  • Harassment, threats, or abusive behaviour toward other users
  • Fake reviews, listings, or accounts
  • Circumventing the platform to avoid fees (taking transactions off-platform)

7. Auctions

  • All bids are binding commitments to purchase.
  • The highest bid at auction close wins and the winner is obligated to complete the purchase.
  • If the winner has a saved payment method, the charge is processed automatically at auction end.
  • Sellers may set a reserve price. Auctions without a reserve sell to the highest bidder regardless of price.

8. Farmers Market

  • Farmers Market sellers must provide a valid RADA, JAS, or Bee Farmers Association ID.
  • All produce must comply with applicable Jamaican food safety standards.
  • Ground provisions must be properly washed and cleaned before delivery.
  • Fresh produce sales are final — see our Returns Policy for dispute procedures.

9. Disputes

Yaadbay provides a dispute resolution process for buyers and sellers. We act as a mediator and our decision is final within the platform. We reserve the right to refund, release, or freeze funds at our discretion while a dispute is open. We are not a party to transactions and are not liable for losses arising from buyer-seller disputes.

10. Intellectual Property

You retain ownership of content you post (photos, descriptions). By posting, you grant Yaadbay a non-exclusive, royalty-free licence to display and use that content to operate the platform. You may not use Yaadbay's name, logo, or branding without written permission.

11. Limitation of Liability

Yaadbay is a marketplace platform and is not responsible for the quality, safety, legality, or accuracy of items listed by sellers. To the fullest extent permitted by law, Yaadbay's total liability for any claim arising from use of the platform shall not exceed the amount of fees paid by you to Yaadbay in the three months preceding the claim.

12. Termination

We may suspend or terminate your account at any time for violation of these terms, fraudulent activity, or any reason at our sole discretion. You may close your account at any time by contacting us. Pending transactions must be completed or cancelled before account closure.

13. Changes to Terms

We may update these Terms at any time. We will notify registered users of material changes by email. Continued use of the platform after the effective date constitutes acceptance.
